TERMS OF USE OF THE PLATFORM www.syldreagardiennage.ca/www.syldreaguarding.ca:
1. DESCRIPTION OF THE PLATFORM
1.1 – User: Indicates the registered individuals and all personal data provided by users (individuals/families and candidates) in connection with the use of the various services of the platform www.syldreagardiennage.ca and their registrations.
1.2 – Identifiers: This is all the information requested to identify families/individuals and candidates in order to access the member-only areas of the platform www.syldreagardiennage.ca/www.syldreaguarding.ca.
1.3 – Candidates: Describes the individuals who offer their services, paid for by the families/individuals who need their services and who are registered on the platform www.syldreagardiennage.ca/syldreaguarding.ca. Candidates are self-employed workers who are not agents, salaried employees, or employees of the www.syldreagardiennage.ca platform. The www.syldreagardiennage.ca/www.syldreaguarding.ca platform does not pay any salaries, makes any proposals, provides any work tools, or monitor the work performed by candidates who are members and registered on the platform.
1.4 – Individuals/families are those individuals or families seeking specific candidates to meet their needs as requested on the platform www.syldreaguarding.ca/www.syldreagardiennage.ca. These individuals/families conduct the research, interviews, and pay the candidates they select for a specific service.
1.5 – The platform www.syldreagardiennage.ca is a platform that contains data of various types, including text, animated or still images, databases, and textual information, which are addressed to users (families/individuals and candidates), who represent the two categories of members targeted by the platform.
The platform www.syldreagardiennage.ca is an online platform where individuals/families who are members of the platform can search the profiles of registered candidates. The platform gives individuals/families the opportunity to advertise jobs for which candidates can apply directly, the platform allows direct exchange between individuals/families and candidates through a messaging service, however the platform does not pay for the provision of services to candidates and the platform cannot guarantee that the information written by candidates and individuals/families on the platform is truly correct, accurate, true and up to date. The role of the platform www.syldreagardiennage.ca is only to operate and maintain the platform which will be an intermediary between individuals/families and candidates, the platform is not associated with, does not employ, does not represent or act as an agent for the candidates registered on the platform. The syldreagardiennage.ca platform should not be perceived as a referral service to benefit individuals/families and candidates. The platform www.syldreagardiennage.ca/syldreaguarding.ca has no employment relationship and is not at the service of individuals/families or candidates registered on the platform. By using the platform www.syldreagardiennage.ca you release the president and employees from all damages and claims that may arise in connection with the use of this platform, any agreement between individuals/families and candidates will be between these two parties, the platform syldreagardiennage.ca/syldreaguarding.ca will not be part of any agreement agreed between the two parties (individuals/families and the selected candidates). The platform will not be responsible for complaints or disputes of any nature that may arise between the two parties (individuals/families and candidates).
1.6 – We strongly advise that individuals/families conduct criminal background checks and reference checks on candidates who will offer their services to them and that they conduct a thorough interview by phone and in person with the successful candidates that you may contact in the context of hiring for the performance of a task or service agreed between you through the platform. It is impossible to certify the authenticity of a user of the platform because the platform cannot in any way confirm that the user is really the person they claim to be, despite all the diligence involved, background checks on candidates are done by a third-party service. To be eligible to register on the platform, candidates and individuals/families must send us a photo of their official Canadian photo ID issued by the Canadian government or the person’s province of residence (passport, driver’s license or provincial health insurance card) and also the certificates of qualifications indicated on the candidate profiles. The documents that will be sent and that correspond to the data entered on the candidate’s profile will receive the mention “validated” by the platform. Each candidate has a box in their profile for criminal background, if this box is not checked, i.e., the candidate has not yet given us their criminal background or has not yet requested a background check through the platform syldreagardiennage.ca/www.syldreaguarding.ca.
1.7 – The syldreagardiennage.ca/syldreaguarding.ca platform is not responsible for, does not assume responsibility for, or guarantee any interviews or meeting opportunities established between individuals/families and candidates registered on the platform. The syldreagardiennage.ca platform database can only be used for legal purposes by specific candidates seeking work and individuals/families seeking candidates who offer their services. It is the responsibility of individuals/families and candidates to maintain open communication with each other to agree on the necessary arrangements to confirm the fulfillment of their employment agreement made through the platform and by telephone between them. The syldreagardiennage.ca platform has the authority to modify the format, nature of publications, modify the content and make decisions regarding profiles, messages and comments without prior notice. Profiles of individuals, families, and candidates who do not comply with the platform’s terms of use may be removed from the www.syldreagardiennage.ca platform without prior notice. The platform may have advertisements that may extend beyond its control; in this case, it cannot be held responsible for any losses or damages caused by marketing and advertising companies that use the platform.
2 – ON THE USE OF THE CONTENT OF THE WWW.SYLDREAGARDIENNAGE.CA/WWW.SYLDREAGUARDING.CA PLATFORM
2.1 – All content on the platform, such as images, graphics, text, icons, buttons, logos, and software, are the property of Agence Syldrea Santé Inc. and the www.syldreagardiennage.ca/www.syldreaguarding.ca platform. They are all protected by copyright, trademarks, and Canadian intellectual property laws, except for content provided by individuals/families and candidates. Individuals/families and candidates grant a non-exclusive license to the content uploaded to the platform www.syldreagardiennage.ca/syldreaguarding.ca, the presentation and assembly of the content transferred and uploaded to the platform is the exclusive property of Agence Syldrea Santé inc and the platform syldreagardiennage.ca/syldreaguarding.ca, all content is protected by Canadian copyright law. Unauthorized use of the content of the platform syldreagardiennage.ca constitutes a violation of copyright and trademarks. No one may modify the content of the platform, plagiarize, sell, change the display, reproduce, copy, distribute or otherwise use the content of the syldreagardiennage.ca platform in any way for public, personal or commercial use, except if a user wants to make changes to the information in his own profile, it is permitted for him to make changes in his own profile. It is legally prohibited to copy, plagiarize and use the content of the platform on other websites or in any computer environment for any reason whatsoever, no one may reproduce or copy code created by the syldreagardiennage.ca/www.syldreaguarding.ca platform to create content for another platform.
3. ILLEGAL USES OF THE PLATFORM WWW.SYLDREAGARDIENNAGE.CA/SYLDREAGUARDING.CA
The platform www.syldreagardiennage.ca strictly prohibits:
3.1 – The publication or display of personal information (data) that is false, misleading, inaccurate, or deceptive, and that does not belong to or reflect the true profiles of users.
3.2 – To use data written/put on the platform syldreagardiennage.ca/syldreaguarding.ca for any reason other than to search for a candidate for a specific need in relation to individuals/families or for candidates to search and apply for employment with individuals or families. All employment agencies and childcare, elderly or pet care companies are prohibited from using the platform to search for personnel for the purpose of officially hiring them or for the purpose of offering them work with an official employment relationship. In the event of non-compliance with these conditions, Agence Syldrea Santé inc/www.syldreagardiennage.ca/www.syldreaguarding.ca may prevent access to the platform immediately without notice and take legal action against the offending company or person without any notice or delay. A formal notice will be sent to the offending company or individual, in which the individual or company that has not complied with clause 3.2 acknowledges that irrevocable damage has been caused to the platform www.syldreagardiennage.ca/syldreaguarding.ca and that the independent criterion met regarding the balance of convenience will be in favor of the platform www.syldreagardiennage.ca/www.syldreaguarding.ca.
3.3 – Cancel, delete, or remove any data and materials posted by a user without their written or verbal consent or permission, or at their request.
3.4 – Use software, computer tools, computer intrusions, and instruments to intrude into the platform and interfere with the proper use and activities of the platform www.syldreagardiennage.ca. Perform actions that may burden and encumber the platform’s infrastructure.
3.5 – Attempting to discover, reverse engineer, or decipher the computer composition and engineering of the software that is an integral part of the platform www.syldreagardiennage.ca/www.syldreaguarding.ca.
3.6 – Copying, stealing, imitating, borrowing, duplicating, or plagiarizing the content of the platform www.syldreagardiennage.ca/www.syldreaguarding.ca.
4 – GENERAL STANDARDS
4.1 – Users of the platform syldreagardiennage.ca/www.syldreaguarding.ca are not authorized to use the platform to transmit, distribute, store, or destroy materials related to the platform content that are protected by copyright, intellectual property rights of others, privacy rights, trademarks, professional secrecy, or advertising rights of a defamatory, offensive, obscene, hateful, racist, abusive, sexist, or discriminatory nature. threatening, violent, and that may disturb, cause embarrassment, or coerce any person using the platform.
4.2 – The use of content of a sexual nature through comments, postings, images, text interactions, and messaging and attachments is strictly prohibited. The platform may at any time remove and ban any posting that is inappropriate and violates the conditions of use of clause 4.2. The platform has the right to exclude and ban any user who does not follow the rules of this clause without prior notice.
4.3 – The syldreagardiennage.ca/www.syldreaguarding.ca platform will not provide any refund to an expelled user, and users irrevocably release the Syldrea Santé Agency and the syldreagardiennage.ca/www.syldreaguarding.ca platform, including its president and employees, from any liability in the event of a user being excluded/expelled and from any decision that may result from inappropriate use of the platform.
4.4 – Users and non-users may not transgress, disobey, or breach the security of the syldreagardiennage.ca platform, including:
4.4.1 – Scanning, probing, or testing the vulnerability of the platform and its system, and violating security and authentication measures without the necessary authorization;
4.4.2 – Attempting to compromise and harm the service of users or the platform by applying viruses to the syldreagardiennage.ca platform, forcing the platform out of service, forging a TCP/IP header or any information contained in the header of any email or posting informational; access data not intended for a user or access a server or account for which the user does not have the necessary authorization and interpose in the service of users, hosts or networks with regard to the sending of emails in large quantities and unauthorized use of a user’s account.
4.4.3 – Violating the security of the platform will give rise to civil and criminal legal proceedings. Agence Syldrea Santé inc and the platform www.sydreagardiennage.ca/www.syldreaguarding.ca will investigate the companies, individuals and bodies that may produce such violations and will collaborate with the police authorities in the prosecution of users who have been involved in the above-mentioned offenses.
5. SUBSCRIPTIONS (MEMBERSHIP)
5.1 – Individuals/families must pay the platform’s subscription fees to contact a candidate. Individuals/families must choose between a monthly, quarterly, or annual subscription. Candidates must also pay the subscription fees to register, view their profiles, and apply for jobs with individuals/families who are also registered on the platform www.syldreagardiennage.ca.
5.2 – Subscription renewals can be canceled by users at any time, but they are automatically renewed with a confirmation email sent to the user. When a subscription is canceled by the user, the user will remain registered on the platform until the end of their subscription, but their subscription will not be renewed.
5.3 – The User must provide accurate financial information for credit card payments. The User must ensure that they have the necessary funds to register on the syldreagardiennage.ca platform and to keep the selected service active.
6. USERS, PASSWORDS, AND OBLIGATIONS OF USERS OF THE PLATFORM www.syldreaguarding.ca/www.syldreagardiennage.ca
6.1 – Your password (which must be kept safe and secure), your username, and the information you have provided on the www.syldreagardiennage.ca platform are your responsibility; they represent the information that allows you to access the platform. If unauthorized or inappropriate use of your username, password, or profile has occurred, it is your responsibility to notify the platform by email at syldreaguarding@gmail.com as soon as possible (within 24 hours of becoming aware of the problem).
7. JURISDICTION
The Terms of Use are governed by and applied in accordance with the laws of the Canadian provinces. The terms are subject to the jurisdiction and jurisdiction of the courts of the Canadian provinces. Although the platform may be accessed from other locations around the world, by accessing the platform www.syldreagardiennage.ca/www.syldreaguarding.ca, you must comply with the Terms of Use, which limit the use of the platform to individuals residing in Canada only. If you reside outside of Canada, it is prohibited to use this platform to offer your services or search for candidates, as registered individuals must reside in Canada, with the required proof of residence. If you live outside Canada, you will be banned from the platform, and your account will be deleted without refund or notice.
8. DISCLAIMER OF WARRANTIES
The www.syldreagardiennage.ca platform does not guarantee that the information posted on the platform by users is reliable, true, authentic, up-to-date, or accurate. The platform does not guarantee that the service is error-free or fault-free. The syldreagardiennage.ca/www.syldreaguarding.ca platform does not guarantee that specific/special needs can be met through candidates registered on the platform, nor that candidates can perform the tasks assigned to them by the individuals/families in the agreement entered into between them.
9. REFERENCE AND GENDER
References to the masculine gender refer to all genders, and words referring to a singular form include the plural form and vice versa. Written communications will be produced in French and English on the platform www.syldreagarding.ca/www.syldreagardiennage.ca.
10. ON USERS WHO MAY USE THE PLATFORM AND THE TERMS OF USE OF THE PLATFORM www.syldreagardiennage.ca/www.syldreaguarding.ca:
10.1 – Declaration of the user of the platform www.syldreagardienage.ca: I am fifteen years of age (15 years of age) or older and I have the right to work in Canada. Use of the platform by a person under the age of eighteen (18) years, considered a minor by Canadian law, must be supervised by those with parental authority. They must exercise the control they deem necessary to ensure the proper use of the platform by minors under their responsibility. All minors must have the authorization of a person with parental authority before submitting personal information through the platform. Good faith and good conduct must prevail, as verification in this regard cannot be carried out by the platform; it must be done by the minor’s parental authority with the platform by contacting it directly.
10.2 – The terms of use express the conditions under which persons residing in Canada are the only ones authorized to use the web platform www.sydreaguarding.ca/www.syldreagardiennage.ca. Individuals residing outside of Canada are not authorized to use the platform. In the event of unauthorized use/registration, these individuals will have their profiles deleted/excluded without notice or refund.
10.3 – This agreement specifies that the terms of use for the web platform www.syldreagardiennage.ca are the property of Agence Syldrea Santé Inc. and the platform www.syldreaguarding.ca/www.syldreagardiennage.ca. The terms incorporate the parameters stipulated by the platform syldreagardiennage.ca/syldreaguarding.ca and by Agence Syldrea Santé Inc. Users of the platform must read all of the terms of use described herein before entering into any transaction with the platform. Users are entirely free to accept or decline the agreement and registration with the web platform syldreaguarding.ca/syldreagardienage.ca.
10.4 – The platform www.syldreaguarding.ca/syldreagardienage.ca is not a referral platform, it is a matchmaking platform, i.e., it is a platform that promotes and helps individuals/families meet candidates to perform the services/tasks they need and candidates to offer, post their specific services and apply to individuals/families for a job or to fill a specific need that individuals/families have, the platform thus promotes the meeting and association between the two parties (individuals/families and candidates). The platform www.syldreagardiennage.ca serves as a matchmaker to facilitate the interaction between individuals/families and candidates, however, candidates will not be paid by the platform, candidates will be paid directly by the families with a verbal or written agreement between them, at their discretion. The syldreagardiennage.ca/www.syldreaguarding.ca platform disclaims any liability for payments due between candidates and individuals/families who met through the platform.
10.5 – The www.syldreagardiennage.ca platform will not conduct any criminal background checks, evaluations, or research on platform users. It is the ENTIRE RESPONSIBILITY of the families/individuals and candidates to take the necessary steps for appropriate background checks, criminal background checks, and reference checks on both parties. Section 18.2 of the Quebec Charter of Human Rights and Freedoms states: “No person may dismiss, refuse to hire, or otherwise penalize a person in the course of their employment solely because they have been convicted of a penal or criminal offense if the offense is unrelated to the employment or if the person has been pardoned.” Users will be responsible for all risks associated with any person they come into contact with or communicate with through the syldreagardiennage.ca/www.syldreaguarding.ca platform, including physical damage, financial and profile losses, damage to your property, moral damages. Acceptance of the use of the www.syldreagardiennage.ca/www.syldreaguarding.ca platform by users constitutes acceptance of these risks.
10.5 – If you do not agree with the terms of use mentioned in this agreement, do not use the syldreagardienage.ca/www.syldreaguarding.ca platform. If you use the www.syldreagardienage.ca platform, you accept all the terms of use established in this terms of use agreement and you acknowledge being bound by the conditions mentioned in the terms of use and you confirm and validate that you have consulted, read, understood and agree with the terms of use and regulations mentioned in this agreement before being a user and subscribing/registering to the platform www.syldreagardienage.ca/www.syldreaguarding.ca.
10.6 – The terms of use set forth herein cover all agreements between the platform www.syldreagardiennage.ca/www.syldreaguarding.ca and the platform’s users; no other separate guarantees are provided to users.
